These general conditions of sale apply to all orders placed on the website gainplus.fr
GAINPLUS® reserves the right to modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in effect on the date of the order will apply to each order.
Product offers and prices are valid as long as they are visible on the site, while stocks last.
For products not stocked in our warehouses, offers are subject to availability from suppliers. In this context, information on product availability is provided on the product sheet "in stock with our supplier" and at the time of placing the order.
If one of the products in your order is out of stock: We will wait for the rest of your order to ship everything to you at once.
The order placed is valid for 6 days open for products available within 8-12 weeks
The order placed is valid for 2 working days for products available immediately.
If payment is not made on time, the order is cancelled.
For any order to be validated, a deposit payment of at least 70% of the price including tax must be made.
The order validation date corresponds to:
- The date of the order in the case of payment by credit card online
- The date of acceptance of credit in case of payment on credit
- The date of receipt of payment in case of payment by transfer
GAINPLUS® reserves the right to modify its prices at any time but undertakes to apply the current rates indicated to you at the time of your order.
4.2 Special conditions for sale products
En période de Soldes, les produits soldés sont identifiables par une signalétique portant la mention “SOLDES” située à côté du prix.
4.3 Delivery costs
The delivery costs applicable on the site are valid for all of France (excluding Corsica and French overseas departments and territories).
They vary for the rest of metropolitan France and will be offered to you after placing your order. You can refuse the cost at any time and your order will be refunded within 24 to 48 hours.
Payment Terms
You can make the payment:
- By credit card: Payment is made on the secure banking servers of our partners. This means that no banking information about you is transmitted via the website www.gainplus.fr. Payment by credit card is therefore completely secure; your order will be recorded and validated as soon as the payment is accepted by the bank you have chosen.
- By bank transfer. You can enter the QR Code issued by our system when confirming your order and payment by bank transfer.
Retention of title clause
The products remain the property of GAINPLUS® until full payment of the order by GAINPLUS®. However, once the order is received by the customer, the risks of the delivered goods are transferred to the customer.
Default of Payment
GAINPLUS® reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is currently being administered.
Penalties of an amount equal to the legal interest rate plus two points are automatically applicable to unpaid amounts after the invoice date or upon notification of rejection of bank payment for any other means of payment without any prior formal notice being necessary and without this clause excluding additional damages. Penalties will be payable from the first day following the payment date shown on this invoice. Delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions herein.
For orders to be paid by financing, non-receipt of the amount due will not result in cancellation of the order unless otherwise agreed between the parties. Consequently, the buyer will remain liable to GAINPLUS® for the amount of their order. Any termination by the customer of an order or contract, outside of the clauses provided for this purpose, gives rise to damages.
Debt collection costs may be charged to the buyer by GAINPLUS®. In the event of legal action, GAINPLUS® is entitled to claim reimbursement from the buyer for any costs of any kind associated with the proceedings.
6.1 Terms and Conditions
The products are delivered to the address you indicated when placing your order.
We remind our customers that their contact details must be provided when placing the order in the customer file, these must be accurate and include all the details necessary for the transport service.
It is imperative for the customer to provide their telephone number so that it can be given to the transport company responsible for contacting them to inform them of the delivery.
In the event of errors made by the customer on the form he completes when placing his order, such as an incorrect telephone number, an incomplete address or any other information which would prevent delivery to the customer, the costs will remain the responsibility of the latter. He will also be responsible for the costs relating to the new dispatch of the order.
6.2 Delivery times
All delivery times announced are calculated in working days.
The times indicated are average times and correspond to the processing, preparation and shipping times of your order (exit from warehouses). They run from the validation of the order.
To this time, you must add the carrier's delivery time.
Exceeding the shipping deadline may result in cancellation of the order if it is not shipped from our warehouses. To do this, simply contact our after-sales service. If the order is in transit by one of our carriers, you must contact our after-sales service within 24 hours of shipping confirmation, so that we can block the delivery. If you receive the package: refuse it and request a refund for your order from our after-sales service. As soon as we have confirmation of the return of your package, we will refund you within 14 days.
For an order consisting of several products or containing a pre-ordered product, the delivery time for this order is then based on the longest delivery time. GAINPLUS®, however, reserves the right to split the order into several deliveries.
The delivery time for each item is specified on the product sheet “delivery time” and may vary depending on the type of products ordered.
The ordered product is delivered by postal service or by an independent carrier, depending on the nature of the product ordered and at the exclusive initiative of GAINPLUS® to the address shown on the order form. The delivery times announced are indicated from our warehouses or those of our suppliers.
The choice of delivery method depends on the weight, volume and value of the items.
Delivery by carrier: by appointment, time announced by the service provider for contact with the customer 96 hours after dispatch of the order.
Accessibility conditions of the delivery location:
The buyer must imperatively inquire either on our website and/or with the seller before purchasing the product(s) he plans to buy, to check the accessibility of the latter to his home, knowing that:
- No delivery to the mountains, delivery to a city center address possible
- Delivery from the bottom of the truck to the delivery address if easily accessible for 20 m³ trucks and if accessible due to weather and geographical conditions.
- It is the customer's responsibility to provide an accessible delivery address, the conditions of which have been specified above.
6.3 Customer responsibility upon delivery
As soon as the consumer takes possession of the product, the risk of loss or damage is transferred to him. Therefore, the customer is asked upon delivery not to sign any delivery slip before having checked the contents of the packages and the condition of the goods. In the event that the customer notices when checking the goods that they do not conform to the order or that they have been damaged during transport, he must refuse and note reservations on the delivery slip. The customer must then inform GAINPLUS® within 48 hours of the refusal of the order.
If the customer has accepted the order, he/she must inform GAINPLUS® within a maximum of 72 hours by email and/or telephone and provide the necessary supporting documents to establish the damage within this same period (photographs of the damaged product, damaged packaging, any reservations made on the transport slip) so that GAINPLUS® can intervene in the event of non-compliance. The customer is also advised to send a letter to the transport company within this same period with the same information.
The customer must keep the package(s) until GAINPLUS® informs them whether or not they need to make the order available to the carrier.
GAINPLUS® shall not be held liable for non-performance of the contract concluded, due to the occurrence of a force majeure event and in particular in the event of a total or partial strike of postal services, carriers, and disasters caused by floods or fires. With regard to products purchased to meet professional needs, GAINPLUS® shall not incur any liability for any indirect damages resulting from this, loss of business, loss of profit, damages or costs, which may arise.
The choice and purchase of a product or service are the sole responsibility of the customer. The total or partial impossibility of using the products, in particular due to equipment incompatibility, cannot give rise to any compensation, reimbursement or questioning of the liability of GAINPLUS®, except in the case of a proven hidden defect, non-conformity, defectiveness or exercise of the right of withdrawal envisaged under article 9.3.
8.1 General information
The legal warranty against hidden defects is valid for two years in accordance with Articles 1641 to 1649 of the Civil Code. It provides that GAINPLUS® guarantees the product against any hidden defects that would make it unfit for its intended use. The customer will then have the option of choosing between a price reduction or cancellation of the sale.

8.2 Legal provisions
Legal guarantee of conformity according to article L217-4 of the consumer code
“The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility.
Legal guarantee of conformity according to article L217-5 of the consumer code
The property complies with the contract:
1° If it is suitable for the use usually expected of a similar good and, where applicable :
- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Legal guarantee of conformity according to article L217-6 of the consumer code
“The seller is not bound by the public statements of the producer or his representative if it is established that he did not know them and was not legitimately in a position to know them.”
Legal guarantee of conformity according to article L217-7 of the consumer code
Defects of conformity which appear within twenty-four months of delivery of the goods are presumed to have existed at the time of delivery, unless proven otherwise.
For goods sold second-hand, this period is set at six months.
The seller may challenge this presumption if it is not compatible with the nature of the goods or the alleged lack of conformity.
Legal guarantee of conformity according to article L217-8 of the consumer code
“The buyer is entitled to demand that the goods conform to the contract. However, he cannot contest conformity by invoking a defect that he knew or could not have been unaware of when he entered into the contract. The same applies when the defect originates from the materials that he himself supplied.”
Legal guarantee of conformity according to article L217-9 of the consumer code
In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods.
However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate compared to the other method, taking into account the value of the goods or the significance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer.
AVERTISSEMENT / MISE EN GARDE IMPORTANTE
Risque de blessure grave en cas de basculement du lit consécutif à une fixation murale non appropriée. FIXATION MURALE OBLIGATOIRE. Ferrure de fixation murale fournies pour un mur maçonné. Le montage des meubles escamotables doit être fait par un professionnel.
Pour éviter que le meuble ne bascule, il faut le fixer au mur de façon permanente. Seule une personne qualifiée* doit procéder à l’installation et à tout réglage ultérieur éventuel du lit escamotable, incluant le démontage. Si le lit escamotable n’est pas solidement fixé (ancré) au mur, celui-ci pourrait basculer et causer des blessures graves à l’installateur, aux usagers du lit ainsi qu’aux personnes se trouvant à proximité du lit. Le choix de fixation dépend du type de mur. Utilisez des fixations adaptées aux matériaux du mur.
* Personne qualifiée : Il est nécessaire d’avoir une bonne compréhension de la structure du mur sur lequel le lit sera solidement fixé, notamment pour la localisation et le positionnement des montants et des pièces de charpente pour une structure de bois ou de métal. Si vous n’avez pas les qualifications nécessaires, assurez-vous que l’ancrage au mur soit fait par une personne ayant les qualifications et connaissances requises.
Lors du choix de l’installateur, assurez-vous de respecter toutes les législations applicables dans la province, l’État ou le pays du lieu d’installation.
Le propriétaire du lit escamotable devrait vérifier à chaque utilisation que les ancrages sont solides et ne présentent pas de signes d’affaiblissement (par exemple si vous sentez bouger les vis d’ancrage en tirant sur le caisson du lit) Ne pas utiliser le lit escamotable si le caisson bouge et ne pas ouvrir le lit escamotable si vous n’êtes pas certain qu’il soit solidement fixé au mur car il pourrait basculer et causer des blessures graves. En cas de doute sur l’ancrage, veuillez cesser immédiatement d’utiliser le lit et le faire inspecter par une personne qualifiée* ou contactez-nous par chat, mail ou téléphone.
GAINPLUS® et ses distributeurs (et leurs responsables, directeurs, agents et préposés respectifs) ne peuvent être tenus responsables de dommages directs, indirects, punitifs, exemplaires, particuliers, fortuits ou consécutifs de quelque nature que ce soit, peu importe le fondement de l’action (contrat, délit, négligence, responsabilité stricte du produit ou autre) découlant directement ou indirectement d’un ancrage impropre du lit ou de la non-conformité aux instructions d’installation de l’ancrage fournies dans ce document.
Délai de retour d’une semaine si les colis ne sont ni ouvert ni abîmés puis le délai de remboursement est de trois semaines par virement.
Loi informatique, fichiers et libertés
Conformément à la loi française “Informatique et libertés” n°78-17 du 6 janvier 1978 modifiée en 2004, le client possède un droit d’accès et de rectification aux informations le concernant et il peut exercer ce droit en envoyant un courrier à l’adresse suivante :

GAINPLUS® informe ses clients que ce traitement automatisé d’informations, notamment la gestion des adresses courriel des utilisateurs, a fait l’objet d’une déclaration à la CNIL.
Bloctel
Bloctel est la liste d’opposition au démarchage téléphonique sur laquelle tout consommateur peut s’inscrire gratuitement afin de ne plus être démarché téléphoniquement par un professionnel avec lequel il n’a pas de relation contractuelle en cours, conformément à la loi n° 2014-344 du 17 mars 2014 relative à la consommation.
La loi précise qu’il est interdit à tout professionnel, directement ou par l’intermédiaire d’un tiers agissant pour son compte, de démarcher téléphoniquement un consommateur inscrit sur cette liste, à l’exception des cas énumérés par la loi.
